Website Usage Terms and Conditions
If you continue to use this website, you agree to comply with and be bound by the following terms and conditions, which together with our privacy policy govern Propelly’s relationship with you and this website. If you disagree with any part of these terms and conditions, please immediately cease using this website. The term ‘Propelly’ or ‘us’ or ‘we’ refers to the owners of the website. The term ‘you’ refers to the user or viewer of our website. The term ‘uploader’ and ‘seller’ refers to the owner of the file which has been uploaded to our servers. The term 'buyer' refers to the person purchasing a file from a seller via Propelly.
1) Using Propelly
While using Propelly, users must not:enter false information into the user system
upload illegal or copyright material
upload misleading content with false information
upload abusive, derogatory, hate, malicious content
upload malicious files, viruses or questionable content
sell personal details whether it be yours or a third parties
2) Sale Disputes
As payments are directly sent to the seller via PayPal, we are unable to issue reimbursements of digital goods. Should a buyer wish to claim a refund they must go directly to the seller and attempt to settle their claim there. While Propelly is unable to issue refunds, we are able to neutrally help both parties reach a conclusion and settle the dispute.3) Abuse:
All uploaded files are manually monitored to help prevent abuse. Should we find a file or document which we believe may be questionable or may have broken this service agreement, we reserve the right to temporarily suspend the account and/or file pending further investigation. In such circumstances, the account in question shall be contacted and may be required to answer questions in connection to the account suspension.Abuse towards our staff is unacceptable and will not be tolerated. You agree that by contacting our team, abusive or spam messages may result in immediate temporary or permanent account suspension without refund.
3.5) Acceptable usage:
Users found to be affecting our services such as, but not limited to, slowing down the network, abusing resources or storage systems will be cautioned and may be suspended if no appropriate action or agreement can be met.4) Data retention & availability
All transactions made through the Propelly payment gateway are recorded In compliance with the Data Retention Directive, we are required to hold all transactional information for a minimum of six months. In addition, all transactions are made visible to the seller via their private dashboard to assist them in keeping track of sales.Should an investigative authority require access to retained transactional or user data, under the ‘Regulation of Investigatory Powers Act’ we are required to provide the information requested.
5) Digital Millennium Copyright Act Notices
Propelly is a United Kingdom based company with strategic geographically placed servers and as such, we are required to comply to Digital Millennium Copyright Act notices. It is in our, and your interest, for Propelly to be able to claim Safe Harbour (§ 512) to keep providing our services. When filing a DMCA report, please ensure that all of the following criteria is met, or action will not be taken against the offending file(s):Your first and last name so we may file this complain for reference.
Your company name. If you are an individual, please state so.
A physical address so that we may send documents should they be required.
The download link of the infringing file on our site.
A link to the original work.
A statement by you that you have good faith belief that the content identified in this take down request is not authorized by its creators.
A statement by you that the information filed this take-down notice is accurate and that you are the copyright owner or have the authorization to act on the copyrights behalf.
An electronic signature of the copyright owner.
This information should be emailed to dmca [at] propelly.com and you should expect a reply within 72 hours detailing the action taken against the file. Additionally we believe in full transparency, as a result, all take-down notices will be published with sensitive information redacted.
6) Service reliability and uptime
Propelly offers you an easy end enjoyable eCommerce solution via our platform. We aim for perfect up time, however downtime - the time where our services are inaccessible - is not always predictable. For these reasons, you agree that we may not be held liable for loss of sales or customers. If for any reason maintenance is required which will effect certain features of our service including, but not limited to the purchase of files, we will inform you prior to the planned maintenance. Service upgrades and maintenance are of paramount importance in keeping Propelly secure; as a result, you agree that we can not be held responsible for any lost sales or customers during maintenance.
